LAND USE PLANNING AND DEVELOPMENT

We are well-versed and experienced in the Cape Town Municipal Planning By-law, 2015, as amended, the City Metro Spatial Development Framework, the Spatial Planning and Land Use Management Act 16 of 2013, the Western Cape Land Use Planning Act and other necessary planning and construction considerations regarding property development in Cape Town.

MUNICIPAL LAW

Erleigh and Associates Inc. has over twenty-years' experience working with the City of Cape Town and is adept in dealing with the City, its laws, By-laws, regulations and processes.

We also assist clients seeking approval  for outdoor advertising with  the by-law and policy regulating  outdoor advertising .

Additionally  with heritage components of land use at the City together with applications in terms of  the National Heritage Resources Act at Heritage Western Cape.

Over a ten-year period, we have achieved approvals for multiple residential developments in Camps Bay, involving land use planning applications. The director of the firm has over twenty-years' personal experience in land use planning applications in Camps Bay, including countless subdivisions.

SKYWATER CENTURY CITY

A contemporary  exciting  development of 122 apartments to be developed overlooking a breathtaking artificial vlei. We assisted the client in overcoming 7 years of refusals to crystalise development rights- within 6 months of our appointment. The project sold out in 7 months.

LANGEBAAN LAGOON

A beautiful residential development of 69 plots with the support of the West Coast National Park with magnificent north-facing beach views along the coast of Langebaan, requiring land use planning and environmental approvals which we took to success on appeal.

FRANSCHHOEK  at STELLENBOSCH 

We succeeded when appointed to appeal refusal of a padel court complex outside the urban edge in a  difficult area for approvals. We are available  to assist developers in the challenging Stellenbosch-Franschhoek environment, where approvals  add material value. We have ongoing work in this area as in the City of Cape Town area.

OBJECTIONS

Our firm was appointed to appeal against approval of an apartment block in Sea Point by the tribunal. The appeal authority, Mayor Hill-Lewis agreed, with our grounds, upholding the appeal and refusing the development, on 18 November 2025.  This assists  us to advise developer applicants' and objectors on  your prospects  of approval and represent clients including concerning decision maker trends

REVIEWS
In the case of Walker a Bantry Bay home owner seeking development rights on the Atlantic seaboard, we brought a successful review to the Cape High Court against  a negative city decision. The court agreed, and on referral back the Mayor as appeal authority approved her application. This seminal case decided in 2024 also developed land use principles aiding development. A copy of the judgment is found here. We have high court reviews which should  succeed in further developing land use law pending decision.
